Information clause

Since 25 May 2018, the Data Protection Regulation (RODO) on the protection of natural persons in relation to the processing of personal data and on the free movement of such data has been in force to better protect your data. Your data has been obtained in the framework of the performance of a contract/service of a commercial nature and includes: name and surname, company name, contact details and email, information on business activities.

Purposes of processing your data: handling sales transactions, delivery and dispatch of goods, processing payments, handling complaints, necessary and correct performance of a contract/service of a commercial nature, including taking action prior to the conclusion of a contract/acceptance of an order at the request of the data subject – the data provided will be processed on the basis of Art. 6 para. 1. b and in accordance with the content of the General Data Protection Regulation, fulfilment of POLFOL’s obligations provided for by law, including in particular issuing and storing invoices and accounting documents, as well as for archiving purposes, protection of POLFOL’s rights in accordance with the law, including in particular pursuit of outstanding payments as part of debt collection and court proceedings, verification of your payment reliability and for the purpose of securing payments due to POLFOL, the legitimate interest of P. P.H. POLFOL Marek Banasik within the meaning of the provisions on personal data protection, to conduct direct marketing of POLFOL products and services and promotional activities now and in the future, to carry out marketing activities and to send commercial information in the case you express your separate consent. POLFOL may transfer your personal data to the following third parties for the purposes indicated above: a. to entities with which POLFOL has concluded a cooperation agreement in order to fulfil the agreement between POLFOL and the given entity, to fulfil POLFOL’s obligations stipulated by law, to protect POLFOL’s rights in accordance with legal provisions and to fulfil a justified interest of POLFOL in the meaning of the provisions on personal data protection, to supervisory authorities, b. to authorities and other third parties in the case where this is necessary for the fulfilment of the purposes indicated above and to fulfil obligations imposed by law.

POLFOL undertakes to apply security measures, both technical and organisational, to protect your personal data, which will be stored by POLFOL only for the time necessary to achieve the purposes for which the data are collected, to fulfil the obligations imposed by law, for the maximum period of securing the materials necessary for legal proceedings (including tax proceedings), and until the possible statute of limitations for your and POLFOL’s claims.

The recipients of your personal data will be: employees of our company authorised to process personal data, entities providing ICT, organisational and technical support to our company, institutions authorised to process personal data under applicable law, mentioned above in point 4 Your personal data will not be transferred to a third country/international organisation.

You have the right to access and correct your data. You also have the right to erasure, to data portability, the right to restrict or request the cessation of processing and the right to lodge a complaint with the supervisory authority – the President of the Office for Personal Data Protection.

The provision of your personal data is voluntary but necessary to perform the activities referred to in this information clause.
